Principle

At TikTok, we want all healthcare and pharmaceutical products and services advertised on TikTok to be in compliance with local laws in each market, and our policies aim to foster an ad platform that prioritizes equipping users with appropriate information.


Policy

Healthcare is a highly regulated area in most markets and we are dedicated to following advertising regulations for healthcare and pharmaceuticals. Some healthcare-related content cannot be advertised at all, while others can be advertised with restrictions in place.


Healthcare-related products and services

Over-the-counter (OTC) medicines, medical institutions, and pharmacies are generally not allowed, but they may be allowed under our policies if certain conditions are met, such as:

  • Licensed by the regional regulating authority

  • Compliance with local laws and regulations

  • Targeted at users aged 18 years and older


Medical devices

We may allow advertisements for select medical devices, tools, and equipment used for diagnosing, treating, or monitoring medical conditions. Where allowed by our policies, they need to be:

  • Approved and certified by the relevant regional authority

  • In compliance with local laws and regulations

  • Targeted at users aged 18 years and older


Baby food and follow-on formula

The promotion of baby food and infant formula intended for children under 6 months is not allowed. For other baby food and follow-on formula products, advertisers must ensure that they:

  • Do not make medical claims or suggest their products are superior or equivalent to breastfeeding.

  • Comply with local laws and regulations.


Hemp and cannabidiol (CBD) cosmetic products

The promotion of products derived from hemp oil and topical CBD products for cosmetics may be allowed in some markets and is subject to additional restrictions. If allowed, ad content and landing pages must comply with the local laws of the target country.

Note: Hemp products are currently not supported via self-serve, and ingestible hemp is prohibited.

Therapeutic goods

-Comply with all local laws and regulations applying to Therapeutic Goods (as that term is defined in the Therapeutic Goods Act 1989 (Cth)), including the Therapeutic Goods Advertising Code, the Therapeutic Goods Regulations 1990 (Cth) and the Therapeutic Goods Act 1989 (Cth) (the "TG Laws")

-Be included on the Australian Register of Therapeutic Goods ("ARTG")


All advertising material submitted to us must:

(a) Be accurate, balanced, and not misleading

(b) Only contain information that is substantiated

(c) Be consistent with any approved indication or intended purpose of the therapeutic good and any applicable label, directions, or instructions for use, consumer medicine information, or patient information leaflet

(d) Not contain any representation that the goods are safe, do not cause harm or side-effects, are a guaranteed cure, or are infallible, unfailing, magical, or miraculous;

(e) Not include a representation that is restricted or prohibited (unless you have received approval from the Therapeutic Goods Administration)

(f) Include all applicable mandatory statements, health warnings, and other information

(g) Not include a testimonial from a person who has been incentivized by any form of consideration

-Where advertising material includes a Testimonial, advertisers must provide proof that they have verified the identity of the person providing the Testimonial and that the person has used the Therapeutic Good

-"Testimonial" means a statement made by a person about their own experience (or the experience of someone under their care) using a Therapeutic Good

-"Endorsement" means an expression of support for a Therapeutic Good that makes no reference to personal use or experience using the good


By submitting advertising material to us, advertisers represent and warrant that:

(a) the advertising materials complies with the TG Laws;

(b) any Testimonial or Endorsement in the advertising material is consistent with the TG Laws and is not made by a:ㅤ

(i) government, government authority, or their employees or contractors;ㅤ

(ii) hospital, healthcare facility, or their employees or contractors;ㅤ

(iii) current or former health practitioner, health professional, or medical researcher;ㅤ

(iv) person who represents themselves as being qualified or trained to diagnose, treat, or prevent disease or injury; andㅤ

(v) In the case of Testimonials only:ㅤㅤ
