TikTok Advertising Policies: Industry Entry - Latin America

Brazil / BR 

Prohibited 

  • Ads promoting complex speculative investment products cannot be advertised on the platform and include (non-exhaustive list): contract for differences (CFDs), financial spread betting, penny stocks, binary options, mini-bonds, P2P loans, and land banking. Short-term loans (repayment period of 90 days or less and 50% APR) are prohibited.

  • Ads promoting NFT's are prohibited.

  • Ads promoting auction industry (known as "Leilão" in Portuguese) are prohibited.

  • Ads promoting gambling-related products or services including fantasy sports, bingo, horse/sports betting and virtual gambling games.

  • Ads promoting credit repair services, bail bonds, get rich quick schemes, pyramid schemes (including non-financial pyramid schemes), multi-level marketing, products avoiding tax, black-market financing, credit card arbitrary cannot be advertised on the platform. 

  • Ads promoting prescription drugs and plastic surgery. 

  • Ads promoting weight loss/management fasting products or services.

  • Ads promoting weight loss/management supplements (including fat burning pills, appetite suppressants, weight loss/detox teas or lollipops).

  • Ads selling or facilitating the online or offline sale of any kind of alcoholic beverage other than beer (wine, liqueur or spirits).

  • Ads promoting alcohol clubs/subscription services or alcohol making kits. 

  • Ads promoting the following dating services are prohibited: infidelity, international brides or brides-by-mail, sexual encounters or an exchange in terms of income/compensation (including goods or services), or other transactional companionship.  

  • Ads marketed directly towards children are prohibited. Ads marketed directly to adults featuring children or teenagers are acceptable. However, these ads are strictly forbidden of trying to persuade children to consume any product or service; promoting products or services incompatible with children and teenagers; featuring children or teenagers in situations that are incompatible with their age, whether illegal, dangerous or socially reprehensible.

Restricted 

  • Financial Services 

    • Advertisers must be licensed by the appropriate authority to provide their financial services, and are responsible for ensuring that their ad content follows local laws and regulations, including the compliance of necessary disclosure requirements for products, such as loans and credit cards; ensuring that such information (e.g. interest rates, APR, transaction fees, disclaimers, repayment periods and representative examples) is clearly presented and given sufficient prominence on the LP.  Loans, including payday loans (in Brazil, this specific type of loan is identified as "Empréstimo Consignado"), credit cards, buy now pay later (BNPL) services and investment services can be advertised with 18+ age targeting.

    • Cryptocurrency advertisers may run ads on the platform with TikTok's explicit permission. They need to be working with a TikTok sales representative, and they must comply with all applicable laws and regulations. These are subject to change. 

  • Pharmaceuticals, Healthcare, Medicines 

    • Ads for products within the pharmaceuticals, healthcare, and medicines sector are allowed. Advertisers must be actively working with a TikTok sales representative.

    • Ads that promote over-the-counter drugs, medical devices (Category I&II only) must comply with local laws request and approved by ANVISA. Ads may also need to target 18+ only. 

  • Religion

    • Disrespectful ads (including from apps/games) toward religious symbols, religious buildings, and religious figures are prohibited. Also, religions' superiority comparisons and ads promoting cults or preaching about religions are not allowed.

  • Beverage

    • Energy drinks require age targeting 18+. 

    • Ads selling, or facilitating the online or offline sale of beer, and ads promoting alcohol-sponsored events are allowed. Advertisers must be actively working with a TikTok sales representative.

    •  Advertisers must include a disclaimer at the end of their creatives, and an age-screening mechanism (e.g., age affirmation page/pop-up) on their landing pages.

    • Advertisers must not: 

      • target persons under the age of 18;

      • use or depict persons under the age of 25 years old;

      • use pregnant women as models in advertising;

      • belittle abstinence from alcoholic beverages;

      • promote excessive consumption;

      • suggest that drinking is beneficial, or that alcohol has therapeutic qualities either as a stimulant or relaxant;

      • associate the consumption of alcohol with enhanced physical performance;

      • improved social standing or better sexual success;

      • depict persons under the influence of alcohol;

      • associate drinking with risky activities (such as driving, operating heavy machinery), antisocial or illegal (e.g., drugs);

      •  emphasize high alcoholic content as a positive quality.

    • Advertisers are responsible for complying with applicable federal and local laws and regulatory guidelines.

  • Social casino games

    • Social casino games must target users aged 18+. Such ads cannot promote real money gambling, or offer monetary prizes or rewards. Social casino games need to meet a number of requirements and are only allowed with TikTok's explicit permission. Advertisers must be actively working with a TikTok sales representative.

  • Dating Applications or Services 

    • Ads that promote dating applications or services must target users aged 18+. Such ads must not be overtly sexual, or reference transactional companionship or cheating, etc. Dating ads should not be sexually suggestive in nature (e.g., focusing on bodies, sexual language or innuendo, etc.) Services and ads focused on transactional relationships or sexual encounters are prohibited. Dating apps need to meet a number of requirements, and are only allowed with TikTok's explicit permission. Advertisers must be actively working with a TikTok sales representative.

  • Live chat apps

    • Ads that promote live chat services must target users aged 18+, and such ads must not be sexually suggestive. Live chat apps need to meet a number of requirements, and are only allowed with TikTok's explicit permission. Advertisers must be actively working with a TikTok sales representative.

  • Lotteries

    • Advertisers promoting lotteries may run ads on the platform with TikTok's explicit permission. They need to be working with a TikTok sales representative, and they must comply with all applicable laws and regulations. These are subject to change.

  • Media and Entertainment

    • Ads that promote films, TV shows, games, or concerts/theater plays must not contain profanity and crude language, sexually suggestive language or images, graphic violence, or drug use, and must be targeted at the appropriate age group.

    • Advertisers are expected to comply with regional age rating requirements. Age targeting should be applied in accordance with the classification, and the ad creative must display the correct classification marking.

  • Condoms & Lubricants

    • Ads for condoms and lubricated require 18+ targeting, and must not focus on sexual pleasure or be overtly sexual in nature. Advertisers may run ads on the platform with TikTok's explicit permission. They need to be working with a TikTok sales representative, and they must comply with all applicable laws and regulations.


Mexico / MX 

Prohibited 

  • Ads promoting prescription drugs and plastic surgery.

  • Ads promoting alcoholic beverages (wine, beer, spirits, etc.), alcohol clubs/subscription services, alcohol making kits, or alcohol sponsored events. 

  • Ads promoting pesticides, plant nutrients and toxic or dangerous substances. 

  • Ads promoting debt assistance programs, credit repair services, "get rich quick" schemes, pyramid schemes (including non-financial pyramid schemes) and multi-level marketing, penny auctions, binary options, cryptocurrency wallets, unaccredited digital banks that perform any traditional bank-like function, cryptocurrency credit or debit cards, initial coin offerings, token sales, or other means of promotion or advertisement of individual digital currencies or tokens.

  • Ads promoting gambling related products or services including fantasy sports, bingo, horse/sports betting and virtual gambling games.

  • Ad promoting weight loss/management supplements (including fat burning pills, appetite suppressants, weight loss/detox products). 

  • Ads promoting the following dating services are prohibited: infidelity, international brides or brides-by-mail, sexual encounters or an exchange in terms of income/compensation (including goods or services), or other transactional companionship. 

  • Ads marketed directly towards children are prohibited. Ads marketed directly to adults featuring children or teenagers are acceptable. However, these ads are strictly forbidden from trying to persuade children to consume any product or service; promoting products or services incompatible with children and teenagers; featuring children or teenagers in situations that are incompatible with their age, whether illegal, dangerous or socially reprehensible.

For all ads within this category, we may ask for disclosure and evidence of appropriate regulator and/or third-party accreditations or certifications. Ads may only target users aged 18+, and must include proper disclaimers if applicable. 

    • Cryptocurrency advertisers may run ads on the platform with TikTok's explicit permission. They need to be working with a TikTok sales representative, and they must comply with all applicable laws and regulations. These are subject to change.

  • Food & Drinks 

    • Ads promoting food and beverages cannot promote eating habits that are harmful to a person’s health, cannot make comparisons to the detriment of the properties of natural food, and cannot imply that the product provides people with extraordinary characteristics or abilities. Ads for food or beverages may not be associated with the consumption of alcoholic beverages or tobacco. Ads promoting food may be required to file a notice with the local regulatory authority. Ads promoting infant formula must comply with local laws and regulations. 

  • Dietary Supplements 

    • Ads for dietary supplements must include a warning statement in Spanish, or applicable local language, following the applicable regulations explaining the health risks and/or the possible effect that the consumption of the product can cause. 

  • Pharmaceuticals, Healthcare, Medicines 

    • Ads promoting pharmaceuticals, healthcare products, medicines and herbal remedies should comply with local laws and regulations, and ads may only target users aged 18+. Ads promoting over-the-counter drugs must be approved by the regional regulating authority, and may not contain misleading or inaccurate claims. Ads promoting herbal remedies must not refer to them as being curative. 

    • Advertisers must be actively working with a TikTok Sales Representative.

  • Hygiene, Perfume and Beauty Products 

    • Ads promoting hygiene, perfume, and beauty products may be subject to restrictions. 

    • Advertisers must be actively working with a TikTok Sales Representative.

  • Media and Entertainment

    • Ads that promote films, TV shows, games or concerts/theater plays must not contain profanity and crude language, sexually suggestive language or images, graphic violence, or drug use, and must be targeted at the appropriate age group.
