TikTok One Brand Code of Conduct

TikTok One Creative Suite Brand Code of Conduct


1. Overview

The purpose of this TikTok One Creative Suite Brand Code of Conduct (“TikTok One Brand Code”) is to: (i) encourage a positive commercial environment on the TikTok One platform; and (ii) provide clarity to users of the TikTok One platform regarding expectations about their behavior on, and restrictions applicable to their use of, the TikTok One platform. This TikTok One Brand Code forms part of the TikTok One Brand Terms. You must comply with the TikTok One Brand Terms, the TikTok One Brand Code, and all other applicable terms, policies, and guidelines (collectively, the “TikTok One Policies”), in connection with your use of the TikTok One platform. If you fail to do so, TikTok may take actions to enforce the TikTok One Policies, including those set forth below. You may also be required to take specific actions to remedy any such failure to comply. This TikTok One Brand Code is not intended to be exhaustive and may be updated from time to time. Please check this page regularly to ensure that you are complying with the current TikTok One Brand Code. Capitalized terms not otherwise defined in this TikTok One Brand Code shall have the meaning given to them under the TikTok One Brand Terms. To the extent any specific provision of this TikTok One Brand Code conflicts or is inconsistent with any term of the TikTok One Brand Terms, the specific provision of this TikTok One Brand Code will prevail.


2. Prohibited Behavior

Below is a list of some of the types of conduct that are prohibited on the TikTok One platform. You agree to not engage in, and not encourage others to engage in, this type of prohibited conduct. Remember that this list is not exhaustive so please always consider if your conduct is appropriate for the commercial environment on the TikTok One platform.

Deceptive Behavior

  • Fake Brand or Information: Using a brand name or information (including in your engagement with Creators) in a way that is inaccurate or misleading, or that violates applicable laws and regulations.

  • Impersonation: Impersonating another person or entity (such as TikTok) or falsely stating or otherwise misrepresenting your affiliation with another person or entity.

  • Genuine Interactions: Using the TikTok One platform as a marketing channel for your own products or services or for reasons other than to engage in business with or collaborate with others for the commercial purposes described in documentation, websites, and materials made available by TikTok.

  • Fake, Fraudulent, or Misleading Content: Providing any content or engaging in a communication, or encouraging a Creator to create content or engage in a communication that, promotes, encourages, or facilitates false or misleading claims or content (such as fake reviews, ratings, discount codes, promotions, or misleading content, that promises one thing but delivers something substantially different).

Objectionable Behavior

  • Harassment: Threatening or attacking Creators or using insulting or derogatory language in communications with Creators.

  • Discrimination: Discriminating against Creators in any way based on protected characteristics or including discriminatory requirements in campaign briefs or other campaign materials.

  • Objectionable Content: Providing, making, or engaging in, or requesting Creators to provide, make, or engage in, any content that exposes TikTok, the TikTok One platform, or other TikTok One platform users to any harm or liability of any type.

  • Encouraging Policy Violations: Requesting that a Creator not comply with applicable terms, policies, guidelines, laws, or regulations (such as encouraging a Creator to not comply with the Branded Content Policy).

  • Encouraging Off-Platform Activities: Requesting that a Creator engage in activities on (including posting TikTok One Creator Content on) third party platforms.

  • Spam: Creating multiple accounts to bypass any restrictions or limitations applicable to the TikTok One platform (such as maximum search limits or order limits).

  • Payment Fraud: Engaging in any type of payment fraud, including unauthorized use of credit cards or other payment methods, illegitimate chargebacks, or any other method of obtaining TikTok One Creator Services without required payment.

Unprofessional Behavior

  • Unresponsiveness: Repeatedly failing to engage with a Creator in good faith (such as by failing to negotiate with a Creator in good faith, and failing to review and provide timely feedback regarding content created by a Creator).

  • Incomplete Information: Sending Creators, or uploading to the TikTok One platform, details, information, or requests that are incomplete or unclear.

  • Violating Terms with Creators: Failing to comply with any separate contract between you and a Creator that is related to your activities on the TikTok One platform.

  • Failure to Pay Creators: Refusing to pay a Creator as agreed or failing to make a timely payment to a Creator.

  • Inappropriate Cancellations: Canceling an order in violation of applicable contracts (such as a contract between you and a Creator) or engaging in cancellations that lead to negative Creator experiences or complaints (such as repeat cancellations).

Engaging with Restricted Content/Creators

  • Providing Previously Removed Content: Providing any content, or requesting a Creator to provide any content, on the TikTok One platform that has previously been removed by TikTok (including content removed due to it violating any applicable TikTok One Policies).

  • Content from Restricted Creators: Providing any content, or requesting a Creator to provide any content, on the TikTok One platform from a Creator whose access to the TikTok One platform has been suspended or terminated.


3. Best Practices

Creators are more likely to engage with you if you provide truthful, accurate, and complete information about who you are, why you want to work with a specific Creator, the amount you are willing to pay for the applicable services, and your requirements for the services (including the creation of any content). In order to have positive collaborations with Creators, we strongly encourage you to do the following:

  • Make Appropriate Offers: For campaigns where you pay the Creator directly, do not propose to pay a Creator an amount that is significantly lower than the Creator’s disclosed rate (if any is disclosed).

  • Create Effective Briefs: Read and follow the practices set forth in Help Center articles and other best practices provided by TikTok.

  • Communicate Professionally: When communicating directly with Creators, be responsive, professional, and courteous.


4. Contracting with Creators

If you are using a separate contract with a Creator in connection with any TikTok One Creator Services, you will do the following:

  • ensure that such contract clearly defines each party’s rights and responsibilities;

  • consider seeking legal advice before entering into such contract with a Creator;

  • be clear and upfront about the contract terms, especially terms relating to payments and how and when the content created by a Creator may be used; and

  • ensure that the contract complies with all applicable laws and regulations.


5. Enforcement & Appeal

TikTok may, at its sole discretion, take actions to enforce this TikTok One Brand Code and the other TikTok One Policies. Examples of such actions include:

  • limiting or disabling your ability to search for or send invitations to Creators;

  • disabling your ability to create new campaigns;

  • limiting or disabling your ability to use certain features;

  • requiring you to use certain features (such as an online payment);

  • suspending or terminating your account;

  • permanently banning you from using any products or services of TikTok or its affiliates; and

  • any other actions that TikTok deems necessary, including those necessary to protect TikTok, its affiliates, and other users from liability or harm.

When taking an enforcement action, TikTok may consider the severity and frequency of the relevant violation(s). TikTok may use human reviewers, machine learning, or other methods to identify and enforce violations of applicable TikTok One Policies.

Details of enforcement action taken against you may be provided through notifications sent through the TikTok One platform.

If you disagree with any enforcement actions taken against you, you may file an appeal by submitting a ticket through the Help Center. You must provide sufficient evidence and reasons to support the appeal.


6. Report Misbehavior

All users of the TikTok One platform must comply with the TikTok One Policies. If a user asks you to violate, or if you are aware of another user violating the TikTok One Policies, you can report this to TikTok by submitting a support ticket through the Help Center.
